The present legal process is woven around a legal issue arising from the timely application of the provisions on determining the “definitive” judgment which is the enforceable title and the moment when the limitation period for the right to enforce forced execution when the litigation started under the old Civil Procedure Code and the rulings in the appeal and the recourse, respectively enforcement, were pronounced, respectively started under the new Civil Code and the new Civil Procedure Code. The moments of reflection were given to us by a case concerning the contestation of execution, a dispute in which the right to enforce enforcement was invoked.References
