THE CONFLICTUAL NORM

The conflictual norm is the specific legal rule of the private international law which resolves the conflict of laws, meaning that it designates the competent domestic law that would rule the legal relationship with foreign element. The law system thus designated is called "the case law" (lex causae). The conflict norm has a peculiar physiognomy, in the ensemble of all the legal rules, not only in terms of the role it performs, but also in terms of its structure. The conflictual norm is made up so as to match the mission that the private international law has conferred it- which is to show the competent norm that would rule directly and immediately the rights and obligations of the legal relationship with foreign element. Therefore, the conflictual norm has a beforehand and indirect character because it solves the conflict of laws.References
