Description:
This paper offers a remarkable analysis of the Charter of Fundamental Rights of the European Union, following its history and presenting the fundamental rights contained in this emblematic document for the European Union. The paper begins with a review of the emergence of fundamental rights in the European Union, starting with the presentation of the revolutionary decisions of the Court of Justice in cases such as Internationale Handelsgesellschaft, Nold, Rutili, Hoechst, etc., and reaching a detailed analysis of the Charter of Fundamental Rights. . Thus, the fundamental rights inserted in the Charter are analyzed evolutionarily and compared to the provisions of the European Convention on Human Rights. The correlation with this traditional instrument on the protection of human rights in Europe is proving interesting, in order to try to predict the future relations between the European Union and the Council of Europe in the field of fundamental rights. Finally, the paper addresses the mechanisms for the protection of human rights developed at Community level, as well as the role of Community institutions and other Community bodies that have been set up to promote and guarantee the protection of fundamental rights.
