The paper follows a general analysis of the franchise agreement. As a structure it has 5 sections, respectively: general aspects, the conclusion of the contract, the effects of the contract, its termination and a comparison with other countries regarding the regulation of the franchise contract. In the Romanian law system, the franchise was defined from a legal point of view, the first time in 1997, by O.G. no. 52 regarding the legal regime of the franchise. Due to the deficiencies presented by that definition, by Law no. 79/1998, the definition of the franchise was again modified and completed, so the franchise is a marketing system based on a continuous collaboration between natural and legal persons, financially independent, through which a person, called a franchisor, grants to another persons, called the beneficiary, the right to operate or develop a business, product, technology or service.
