Description:

The application of the criminal law consists in the action by means of which the norms established by the legislator are applied to those concrete cases that appeared every day. Speaking about the application of the criminal law, we take into account the reality that it is achieved within certain limits related to space, time, people and facts. Violation of the criminal legal norms has the effect, in general, of the criminal liability of the one who violated them. To be useful, criminal liability is governed by certain principles, which include the inevitability of criminal liability. According to him, the commission of a crime necessarily entails criminal liability, but the exceptions are cases in which it is removed by the legislator. In this regard, the Criminal Code stipulates that the following are general causes for the removal of criminal liability: amnesty, limitation of criminal liability, lack of prior complaint, withdrawal of prior complaint and reconciliation of the parties.
