Crimes against life are mainly characterized by their material element, which consists in achieving the social values protected by law. This touch can have the most serious consequence, namely the extinction of life and the physical dissolution of the person. The degree of social danger presented by the incriminated deeds under the generic name of “homicide” is particularly high, endangering not only the security of each person, but implicitly of the entire community. This is because, without ensuring the legal framework that guarantees respect for people’s lives, a peaceful coexistence is not possible, both at microsocial and macrosocial level. Although the acts of homicide seriously injure the same social relations, being likely to result in the death of a person, the degree of social danger that each presents differs in relation to the form of guilt, the relationship between the perpetrator and the victim, how committed the crime, etc. It should be noted that the mentioned differences affect both the sanction and the content of the incriminations. The Romanian Criminal Code, under the generic name of “homicide”, criminalizes the facts that harm human life, as a fundamental and indispensable attribute of the person and on which his existence and being depends.
